By accessing or using the ScubaTribes website, services, or applications (collectively, the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the Platform.
You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
ScubaTribes reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
To access certain features of the Platform, you may need to create an account. You agree to provide accurate, current, and complete information and to update such information to keep it accurate and complete.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify ScubaTribes immediately of any unauthorized use of your account.
Important Points Program Disclaimers: Please read these terms carefully as they govern your ability to earn and redeem points.
Users may earn points ("Points") by completing surveys, joining the waitlist, or participating in other activities as determined by ScubaTribes. Points are not a cash equivalent and have no monetary value.
Notwithstanding anything to the contrary, no user may accumulate more than 500 Points total, regardless of the number of surveys completed, waitlist signups, or other activities performed. This limit applies per user, per household, and per email address. Completing multiple surveys (whether the same survey multiple times or different surveys) will not entitle any user to more than 500 Points.
Points may only be redeemed when, and if, ScubaTribes officially launches and approves Points for redemption. ScubaTribes retains sole and absolute discretion to determine:
Points are not guaranteed to ever become redeemable. ScubaTribes makes no promises, representations, or warranties that Points will have any value or that users will be able to redeem Points for any goods or services. Points are offered as a gesture of appreciation only and should be considered purely symbolic.
Points will only become valid, if at all, upon the occurrence of all of the following:
No Points shall be considered earned, vested, or valid until all three conditions above are satisfied.
ScubaTribes makes no commitment or representation regarding when, if ever, Points will become redeemable. Points may become redeemable weeks, months, or years after being earned—or never at all. Users acknowledge that there is no defined timeline for Points activation or redemption.
ScubaTribes reserves the right, in its sole and absolute discretion, to:

ScubaTribes reserves the right to investigate any suspected fraudulent, abusive, or unlawful activity relating to the Points program. This includes, but is not limited to:
ScubaTribes may, in its sole discretion, void any Points earned through such activity, suspend or terminate user accounts, and take any other action it deems appropriate.
Points are non-transferable and may not be sold, traded, gifted, or combined with Points from any other user. Points have no cash value and are not redeemable for cash.
The Platform, including its content, features, and functionality, is owned by ScubaTribes and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
ScubaTribes grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SCUBATRIBES DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCUBATRIBES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM.
WITHOUT LIMITING THE FOREGOING, SCUBATRIBES SHALL HAVE NO LIABILITY WHATSOEVER RELATED TO THE POINTS PROGRAM, INCLUDING BUT NOT LIMITED TO THE VALUE, REDEEMABILITY, OR EXISTENCE OF ANY POINTS. USERS ACKNOWLEDGE THAT POINTS HAVE NO GUARANTEED VALUE AND MAY NEVER BECOME REDEEMABLE.
You agree to indemnify, defend, and hold harmless ScubaTribes, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Platform or violation of these Terms.
ScubaTribes reserves the right to terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
These Terms shall be governed and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the Hong Kong International Arbitration Centre (HKIAC). The arbitration shall take place in Hong Kong and shall be conducted in English.
If any provision of these Terms is held to be unenforceable or invalid, such provision shall be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and ScubaTribes regarding your use of the Platform and supersede all prior agreements and understandings.
